Who we are. Zootown LLC (“Zootown,” “we,” “us” or “our”), 416 S 9th St., Boise, ID 83702, operates the Zootown Festival at the Missoula Fairgrounds in Missoula, Montana, and is responsible for the personal information described in this Policy. This Policy should be read together with our Terms of Use.

This Policy describes how we treat personal information we collect both online and offline. This includes on our websites and in our apps. It also includes information we collect at the Festival and its box office, and in phone, text message or email interactions you have with us.

Our Privacy Policy has been designed with you in mind. How the policy applies to you will depend on the way in which you interact with us. For example, if you:

1. Register to receive information or updates by email or text message, we will use the information you provide us to fulfill our obligations to you in delivering that service, and, where permitted, keep you up to date about events that may be of interest to you; and
2. Browse our site, we use cookies to tailor your experience and hopefully provide you with a seamless experience.

What Information We Have & Where We Get It

We collect information from and about you.

Information you post. We collect information you post in a public space on our website or on a third-party social media site.

Demographic information. We might collect information like your age range or gender, or, if you choose to answer an optional survey question, your racial or ethnic background, or information about events you like or products you buy. We might collect this as part of a survey, for example.

Accessibility Information. If you request an accessibility accommodation, we collect the information you choose to give us about your needs, which may include health information. We use it only to provide the accommodation, and only with your consent.

Other information. We may collect information about the browser and device you’re using, your IP address, your general location (based on your IP address) and, if you allow it in our app, your precise location, the site you came from, the site you visit when you leave us, and how you used or didn’t use our site or app. We may collect this using technology such as GPS and Wi-Fi.

Contact and account information. We collect your name, email address, phone number, mailing address and account login details when you create an account, sign up for presale access or updates, enter a contest, or contact us.

Purchase and payment information. Tickets are sold through our authorized ticketing provider (currently Front Gate Tickets). We receive your name, contact details, order details, ticket type and seat, and payment-plan status from them. Payment card details are processed by the ticketing provider or our payment processors, and we do not store full card numbers.

Information we collect at the Festival. When you attend, we and our vendors may collect information through ticket and wristband scans (including RFID), cashless payment accounts, ID checks for age-restricted areas or alcohol purchases, security cameras, on-site Wi-Fi, lost-and-found, and incident or medical reports. Photography, video and audio recording take place throughout the Festival, and you may appear in them.

We collect information in different ways.

We collect information directly from you. For example, if you register to receive information or updates from us. We also collect information if you post a comment on our websites or ask us a question.

We collect information from you passively. We use tracking tools like browser cookies and web beacons. We also collect information from our apps.

We get information about you from third parties. For example, if you use a social media feature within our websites or apps or post to a social media platform, the social media site will give us some information about you. We also receive information from our ticketing provider, from artist or partner marketing lists you have joined, and from analytics and advertising partners.

We use information to sell tickets and run the Festival. We use your information to process ticket and product orders, payment plans, transfers, upgrades and refunds, to admit you to the Festival, and to send you important updates about the Event, such as schedule, weather and safety notices.

We use information to respond to your requests or questions. For example, we might use your information to confirm your registration for an event.

We use information to improve our products and services. We might use your information to customize your experience with us. This could include displaying content based upon your preferences.

We may use your information to make our website, products, and services better. We may combine information we get from you with information about you we get from third parties.

We use information for security purposes. We use information to protect our company, our customers, or our websites. This includes to detect or prevent unlawful behavior.

We use information for marketing purposes. For example, we might send you information about special promotions or offers. We might also tell you about new features or products. These might be our own offers or products, or third-party offers or products we think you might find interesting.

We may also use push notifications on our mobile apps. We may use push notifications and your location information in our apps to send you alerts regarding local events. We will ask your permission before collecting precise location, and you can withdraw it at any time in your device settings.

We and our advertising partners use cookies, pixels, software development kits and similar technologies to measure our marketing and to show you ads for the Festival on other sites and apps (“targeted advertising”). We use information as otherwise permitted by law or as we may notify you.

We keep your information as long as it is necessary or relevant for our business. We also keep information to resolve disputes, enforce our agreements and otherwise required by law.

Who We Share Your Data With & Why

We may share information with third parties.

We will share information with third parties who perform services on our behalf. For example, we share information with vendors who help us manage our IT infrastructure or who fulfill your purchases. Some vendors may be located outside of the United States.

We share information with our ticketing provider. We share information with our authorized ticketing provider and payment processors to process orders, transfers, payment plans and refunds, and to prevent fraud and bot activity.

We will share information with our business partners. This includes a third party who provides an event such as artists and co-promoters, or sponsors an event, or who operates a venue where we hold events. This may also include third party advertisers who may collect information when you interact with our site. Our partners use this information as described in their privacy policies, which may include sending you marketing communications. Some of this sharing, and our use of advertising cookies, may be considered a “sale” of personal information or “targeted advertising” under certain state laws. You can opt out as described below.

Your Choices & Rights

You have certain choices about how we use your information.

You can opt out of receiving our marketing emails. To stop receiving our promotional emails, follow the instructions in any marketing email you get from us. You can also change your preferences in your account. We will process your request within 10 business days. Even if you opt out of getting marketing emails, we will still be sure to send you transactional messages. For example, we may still contact you about your orders.

You can opt out of text messages. Reply STOP to any marketing text message from us, or tell us by any other reasonable means (such as by emailing info@zootownfestival.com), and we will stop sending you marketing texts within 10 business days. Reply HELP for help. Message and data rates may apply. Consent to receive marketing texts is not a condition of purchase.

You can control cookies and tracking tools. You can use privacy settings on your device or browser app to block cookies. You can also opt out of the sale or sharing of your personal information and of targeted advertising by clicking “Your Privacy Choices” in the footer of our website, or by turning on a recognized opt-out preference signal, such as Global Privacy Control (GPC), in your browser. We treat these signals as a valid opt-out request for that browser.

You can control tools on your mobile devices. For example, you can turn off the GPS locator or push notifications on your device.

Your Privacy Rights.

You have choices about how to control the collection, use, and sharing of your personal information.

Depending on where you live, you may have specific rights around your personal information. Below we explain what those rights are and how you can exercise them:

• Access and Portability. You have the right to confirm whether we process your personal information and to obtain a copy of it in a portable format.

Montana, Oregon and Other State Residents: Residents of Montana, Oregon and other states with comprehensive privacy laws have the rights described above, subject to the exceptions in those laws. To verify your identity, we may collect information such as your full name and email address. This information will be compared to our existing records to verify the identity of the individual submitting the request. We may also require you to confirm your request via an automated email message before responding to your privacy rights request. Depending on the sensitivity of the information requested and the type of request, we may require additional information to verify your identity before responding. We will respond to your request within 45 days. When reasonably necessary, we may extend that period once by an additional 45 days, and we will tell you if we do. If we deny your request, you may appeal by emailing info@zootownfestival.com with the subject line “Privacy Request Appeal.” We will respond to your appeal in writing within 60 days and explain our decision. If your appeal is denied, you may contact your state attorney general, such as the Montana Department of Justice, Office of Consumer Protection.

Sensitive Personal Information. Sensitive personal information includes precise geolocation, health information and racial or ethnic origin. We collect it only with your consent where required by law, use it only to provide the goods and services you requested or for other limited purposes permitted by law, and do not sell it or use it for targeted advertising.

Data Retention and Deletion. How long we retain personal data will vary depending on the products or services we provide and our legal obligations under applicable laws. Our retention periods are generally informed by three factors: 1) Is this information necessary to provide the product or service? 2) What consent have you provided around our use of this information? and 3) What statutory, contractual, or other legal obligations do we have to retain this information? For example, we generally keep order and payment records for 7 years for tax and accounting purposes, keep marketing contact information until you unsubscribe or 3 years after your last interaction, keep security camera footage for 30 days unless it is needed to investigate an incident, and do not retain ID scan data beyond verifying age.

We securely delete or de-identify personal data after the relevant limitation or retention periods have expired.

Your “Do Not Sell or Share” Rights Under the CCPA. Under the California Consumer Privacy Act (CCPA), California residents have the right to opt out of the sale or sharing of their personal information, as defined by the CCPA. California residents may exercise this right by clicking the “Your Privacy Choices” link in our website footer or by enabling Global Privacy Control in their browser.

You may designate an authorized agent to submit requests on your behalf. For an authorized agent to be considered verified, you must provide the authorized agent with signed, written permission to make such requests, or the agent must have a valid power of attorney. We may follow up with you to verify your identity before processing an agent’s request. If you are an authorized agent submitting a request on behalf of another individual, please use the methods listed above to make this request.

“Shine the Light” Law. If you are a California resident and have an established business relationship with us, you can email us at info@zootownfestival.com to request a list of the personal information we have shared with third parties for their marketing purposes. We will also give you a list of the third parties that have received your information. You can make a request one time each year.

Mention in your email that you are making a "California Shine the Light" inquiry. We will respond within 30 days.

Do Not Track. Our websites and apps are not designed to respond to "do not track" requests from browsers. However, we do honor Global Privacy Control and other legally recognized opt-out preference signals, as described above.

Our sites and apps are not intended for children.

Our sites and apps are intended for adults and are not directed to children under 13. We do not knowingly collect personal information from children under 13, and we do not sell the personal information of, or use it for targeted advertising directed to, consumers we know are under 18 without any consent required by law. We store information both in and outside of the United States.

If you live outside of the United States, you understand and agree that we may transfer your information to the United States. This site is subject to United States laws, which may not afford the same level of protection of those in your country.
